Jun-Pierre Art Workshops Waiver of Liability Agreement

This Waiver of Liability Agreement (hereinafter referred to as the "Agreement") is made and entered into as of the date signed below, by and between Jun-Pierre Shiozawa (The Organizer) and the undersigned participant (hereinafter referred to as the "Participant").

1. Description of Activity

The Organizer is hosting an 8-day workshop in Japan, scheduled to take place from April 7 - 15, 2025 (hereinafter referred to as the "Workshop"). The Workshop includes various activities, which may include, but are not limited to, sightseeing, transportation, accommodation, guided excursions, dining, and other related activities.

2. Assumption of Risk

The Participant understands that participation in the Workshop may involve inherent risks, including but not limited to, transportation accidents, personal injury, property damage, illness, or other unforeseen events. The Participant acknowledges that they are voluntarily participating in the Workshop with full knowledge of the potential risks and hereby agrees to accept and assume any and all risks of injury, death, or property damage, whether caused by the negligence of the Organizer or otherwise.

3. Release and Waiver of Liability

In consideration for being permitted to participate in the Workshop, the Participant hereby agrees to release, waive, discharge, and covenant not to sue the Organizer, its owners, affiliates, and representatives (collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant or to any property belonging to the Participant, whether caused by the negligence of the Released Parties or otherwise, while participating in the Workshop or in any activities related to the Workshop.

4. Indemnification

The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or in connection with the Participant's participation in the Workshop, including but not limited to any claims brought by third parties arising out of the Participant's actions during the Workshop.

5. Medical Treatment

The Participant acknowledges and agrees that the Released Parties are not responsible for providing medical care, medical treatment, or medical services during the Workshop. The Participant further agrees that any medical or other personal expenses incurred during the Workshop are the sole responsibility of the Participant. The Participant is strongly encouraged to obtain travel insurance to cover such expenses.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of France, without regard to its conflict of laws principles.

7. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable. If any provision of this Agreement is found to be invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

8. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to such subject matter.

By signing up to the Traveling Through Watercolor: Japan program, I acknowledge and represent that I have carefully read this Waiver of Liability, Acknowledgment and Assumption of Risk, Release of Liability, and Indemnification Agreement in its entirety, fully understand and accept its terms.
